The mandatory entry into force for both registration and deregistration will now be moved from 1 January 2024 to 1 April 2024. Until 30 June 2024, a transition period without sanctions will be observed.

But what exactly does this extension of the notification requirement mean for your cleaning company?

 

The Programme Law of 2022 provides for extensive and mandatory attendance registration for maintenance and/or cleaning activities of immovable property. For example, in the future, arrivals and departures, as well as rest breaks at the workplace, will have to be registered electronically with the National Social Security Office (NSSO) and the registration obligation will be extended to workplaces (  regardless of  value) and to all natural persons, regardless of their status, who are present at a workplace where maintenance and/or cleaning work is carried out.

The obligation does not apply to:

  • In-house cleaning staff for government offices or private individuals
  • The natural person who carries out cleaning work for private purposes
  • Service voucher companies

How?

Attendance will have to be recorded by means of an electronic attendance registration system or other recording method.

  • An electronic attendance recording system

 

The electronic attendance recording system shall consist of:

  • database in which attendance recording data are entered.
  • Registration Device / Time Clock
  • means of registration. This can be a badge, for example. 
  • Other Automatic Registration Method

 

The NSSO itself will make a secure electronic application on the social security portal available to the persons subject to the registration obligation. In this context, a new application is being developed, namely "Checkinandoutatwork".

 

What data needs to be recorded?

The registration system must record the following data:

  • the identification data of the natural person
  • the address or geographical description of the place of work
  • Employee Capacity
  • the employer's identification data
  • Date - times of departure and arrival at the workplace as well as the date and all start and end times of rest breaks at the workplace

 

Obligations of contractors and subcontractors

  • he must use the recording device to register his employees or the self-employed persons to whom he has recourse;
  • And he must make the recording equipment available to any subcontractor to whom he has recoursed, unless they agree to use another equivalent method of registration.
  • He must ensure that any natural person who carries out activities on his behalf records the beginning and end of his activities at the place of work and rest breaks at the time when these activities begin and end;
  • He shall be responsible for dispensing the recording device to his employees, which is compatible with the recording device used at the workplace;
  • If he uses a self-employed person, he must ensure that the self-employed person is in possession of a recording device compatible with the recording equipment at the workplace.

 

Sanctions?

Depending on the violation, sanctioned with a level 1 or level 3 sanction (this is an administrative fine of 400 to 4,000 euros or a criminal fine of 800 to 8,000 euros.
